i have been looking for job through consultancy..no luck yet...my h1 starts on oct 1..i am in opt right now..so before oct can i go for masters..will my consultancy be able to do anything wrong to me...i was worried 'bcoz after oct i will be one of their employees legally...any suggestions would be highly appreciated..

aint a damn thing they can do. there is no bondage labor law in the US. u can join n leave as u please - however some companies prohibit u to work for a competitor for some period. since ur going back to school u should be fine.

How difficult is the process of transferring  H1 visa into the F1 visa? Can we do it without notifying my current employer?

You don't have to notify the current employee. Just get the I-20 from the school you are attending. Then file for change of status I-539.
